When Congress passes a piece of legislation, it does not become law until the President signs it. W can also veto the law. Unlike Cheney, who has involved himself with the legislative process only seven times since January, 2001, W has cast the key vote on every law to hit the books since that time.
Not only that. Bush's signing statements have, in essence, re-written many laws. He is not just part of the legislative process -- he is the ultimate legislator.
Therefore, the President isn't really a part of the Executive branch. Any laws or Executive Orders regulating members of that branch do not apply to George Bush.
