DIEB-Throat's revenge

I sent Brad Friedman a kidding email: "See what you've done?"

After he printed a story about Dieb-Throat's revelation of a "back door" at Diebold, the company's stock plunged dramatically.

Evil schemes began to form in my mind: A blogger could publish material injurious to a firm...and when the stock takes a hit, said blogger could buy up shares. When the stock rebounds, presto! Instant money.

(Guys like me are good at thinking up schemes like that. Republicans are good at actually carrying out schemes like that.)

Well, in truth, that particular scheme is not really do-able. Besides, Diebold insists that the real reason for their current bad fortune concerned management troubles and screw-ups at their ATM division. The vote fraud controversy doesn't figure into the equation. Or so they say.

But -- what if what they say ain't the whole story? And what if this stock dip isn't really temporary?

According to the latest from Brad and Dieb Throat, things may look grim for the company that every lower-d democrat loves to hate:

"What a difference a few months makes," DIEB-THROAT wrote after the market close on Wednesday. "Back in July, Diebold told investors during its conference call the election revenues were sound and expected to grow." Yes, DIEB-THROAT was on that conference call. "Now all of a sudden Diebold's [CEO Walden] O'Dell tells investors of $10 million in lower revenues from election systems alone. Perhaps what Diebold isn't talking about is the $500,000 a month in legal fees they were spending in California, or the current rash of problems with touch screen systems that freeze up when votes are cast.
Problems with the machines led to the banning of Diebold electronic voting systems in California. That's gotta hurt -- hurt the bottom line.

Bad fiscal performance means layoffs. Layoffs mean disgruntled former workers. And that, my friends, is when people start getting blabby.

Remember Enron? Beofre going under, the giant energy concern conspired to deprive California of power in order to drive up prices. But at that time, anyone who suggested that such a conspiracy was afoot was laughed off as a kook. We heard many of those endlessly-clever remarks about tin foil chapeaus. Then the company went belly-up, certain tape recording came out, certain former employees starting gabbing away -- and the tin foil hat aficionados were proven absolutely accurate.

Let's hope that history repeats itself.

And if it does -- and even if it doesn't -- let's always keep in mind that Diebold's rivals in this field are just as filthy.

If you are right about an impending meltdown and consequent tattling by disgruntled workers; and if you are right that there was a conspiracy to steal the election with Diebold being a major player -- then you should expect to see a bailout of Diebold. A government bailout for some reason (saving our election system? Sounds weak.) or a corporate bailout (in the form of a loan package or a merger.) If this happens look for links to Bush's buds.

Even IF Randy above were correct, and validated facts come out of Diebold itself literally PROVING that Bush did not receive the greatest number of electoral votes in 2004, or even 2000, what is the precedent? What would be done?

Would the office fall to the original winner, in Gore/Lieberman? The more-recent winner in Kerry/Edwards? The order of succession?

And who would decide all of this?

If it were to go to the Supreme Court, I think we can be certain that they would once again deny the citizenry their voting rights, declaring a Republican in the line of succession the new King, OR, overruling all consideration of Bush being unseated after so much time has passed.

Hell, perhaps even stare decisis would be the basis of one of new Chief Justice John Roberts' earliest decisions, allowing him to refer to Bush v Gore as a Supreme Court precedent he selectively decides should stand, just before ignoring selectively ignoring it to allow a challenge to Roe v Wade.

Tin foil chapeaus indeed.

Right now, I'd be satsified with: 1. A widespread acknowledgement that such things CAN be, and 2. Arrests.

Reform will then follow.

This voting machine business actually looks to me like a special case of a broader problem that was popularly exposed by Napster. Basically, our social institutions are not up to speed with the technology.

Copying is now easy, accurate, cheap, and available to the common folk, so we make it a crime just so we can keep something like the old copyright system. Rather than update the social institutions, we put brakes on the technology.

Similarly, writing software for widespread use is now a task that can be carried out collaboratively by most any programmer, professional or amateur, providing a possibly huge community who know the software well, yet just for the sake of old-fashioned copyrights and trade secrets we let filthy and reckless individuals keep their half-ass spaghetti code secret.
